December 17, 2012 Regular Meeting

The City Council met in regular session on December 17, 2012 at 7:30 P.M. in the Council Chambers of City Hall.

City employees present were Chief Drew, Public Works Director McFrederick, Attorney Green and Clerk Kennedy.

MINUTES: The meeting was called to order and the minutes of the December 3rd meeting were approved as presented by Councilman Peterson, second by Councilman Lester. Motion carried by a unanimous vote of the Council present.

PUBLIC HEARING ON 8TH STREET VACATION: The public hearing was opened. Three property owners came to listen at the hearing. Rita Wagenmann stated the property lines won’t add up going east and west but it does correct the front yard. Who corrects the east/west problems? Attorney Green stated the burden falls on the landowners to correct the problem between the lots. The problem has developed due to the inaccuracy of the old survey equipment that is now able to be found with new technology. Rita commented that it will be nice to have a front yard. No other comments were made.

The Ordinance will be prepared for adoption at the next meeting.

WWTP PROJECT UPDATE: Public Works Director McFrederick stated most of the work has moved into the building as Holcomb is pretty much done enclosing the building. They will get the heat going and then Blue Water Technology will start working on their portion. Of the 300 day project there are about 90 days remaining.

Councilman Lorentz made a motion, second by Councilman Peterson to approve Pay Request #7 to TML in the amount of $436,281.57. Motion carried by a unanimous vote of the Council present.

The Snowhaven Minutes of December 6, 2012 were accepted on motion by Councilman Lorentz, second by Councilman Lester. Motion carried by a unanimous vote of the Council present.

BILLS: The bills in the amount of $700,381.35 were approved and ordered paid out of their respective funds, on motion by Councilman Lester, second by Councilman Peterson. Motion carried by a unanimous vote of the Council present.

TRAPPING ORDINANCE: Councilwoman Dumas questioned whether the City should also include trapping at the watershed instead of just City limits. Chief Drew felt it would create an enforcement issue since the watershed is not in the City limits.

ORDINANCE NO. 881

AN ORDINANCE OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, PROVIDING REGULATION FOR TRAPPING WITHIN THE CITY; PROHIBITING THE SETTING OF TRAPS WITHIN CITY LIMITS, EXCEPT FOR LAW ENFORCEMENT PERSONNEL AND AS SPECIFICALLY AUTHORIZED BY THE CITY COUNCIL OR THE CHIEF OF POLICE; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; and, PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION; and,

On motion by Councilman Lester, second by Councilman Houger that the first reading be approved, that the rules be suspended, the second and third readings be waived and the ordinance be approved and adopted. Councilman Peterson asked about intentional poisoning. Attorney Green stated poisoning would fall under state code for maliciously injury of property and wouldn’t be addressed in a city ordinance. ROLL CALL VOTE: YES: Dumas, Houger, Lester, Lorentz, Grant, Peterson. NO: none. The motion passed. Mayor Walker then declared Ordinance No. 881 duly approved and adopted.

COUNCIL MEETINGS FOR 2013: On motion by Councilman Lester, second by Councilman Houger to adopt the dates as presented for 2013 council meetings. Motion carried by a unanimous vote of the Council present.

LICENSES: On motion by Councilman Lorentz, second by Councilman Peterson to approve the applications submitted for secondhand & junk store licenses pending filing and payment of application. Motion carried by a unanimous vote of the Council present.

COPIER FOR CITY HALL: Clerk Kennedy explained that the City could save a little money per month by leasing a new copier. The new copier would be capable of printing color which would also save money in various departments. On motion by Councilman Lester, second by Councilman Lorentz to allow the city clerk to upgrade the copy machine on the bid she has.

WEST SOUTH 1ST STREET PROPERTY: Mayor Walker explained he currently owns about 16’-18’ of the road on West South 1st between C Street and D Street. Mayor Walker had it surveyed and wants to clean it up by giving property to the City. He will end up losing a lot of ground on the both sides. He talked to Jeff McFrederick and Bob Mager and came to agreement of what would work for the City for the street. Everything else on South 1st is cleaned up except for this little chunk where the laundry mat/car wash was.

On motion by Councilman Lester, second by Councilman Houger for the City to accept the property donated by Mayor Walker to clear up the right of way and property lines on West South 1st between C Street and the alley to the west pending final deed and legal description from Hunter Edwards.

SURPLUS ITEMS: On motion by Councilman Lester, second by Councilman Peterson to surplus the 2001 Chevy Tahoe with permission to sell in police circles or police buyers and the following list of firearms to surplus in house first for police department. Motion carried by a unanimous vote of the Council present.

ITEMS TO NOTE: The Council received copies of the Revenue and Expenditure Reports for Year End 2011-12, Q & A on Roles and Responsibilities and they were notified of a good training video online for city officials. There will also be a meeting with Jo Bolen on December 18, 2012 at noon to review the FY2011 audit.
