February 3, 2014 Regular Meeting

The City Council met in regular session on February 3, 2014 at 7:30 P.M. in the Council Chambers of City Hall.

City employees present were Chief Drew, Attorney Green, Public Works Director McFrederick and Clerk Kennedy.

MINUTES:  The meeting was called to order and the minutes of the January 21st and January 27th meetings were approved as presented by Councilman Peterson, second by Councilwoman Grant.  Motion carried by a unanimous vote of the Council present.

VISITORSKaty Eimers on behalf of the Syringa Hospital wellness committee explained how the committee wants to create a heart walk route, approximately 1 mile in length along Main Street.   Red 12”x12” hearts would be painted on the sidewalks and maintained annually by the wellness committee to promote wellness in the community.  The paint will be skid resistant and the hearts will not have advertising or logos.  Mayor Walker felt the City needed to be concerned about advertising on the sidewalk, so he felt no logo was a good thing.  If they decide not to maintain the hearts, the hospital would take care of getting the hearts removed.  On motion by Councilwoman Grant, second by Councilman Peterson to allow the hospital employee wellness committee to paint hearts on the sidewalks down Main Street.  Motion carried by a unanimous vote of the Council present.

Carla Wilkins, LCSC Outreach, explained the computer lab can be rented out for meetings and if businesses are looking for specific training opportunity to let her know as she can work to get some of the classes locally.  She requested permission to hold the scuba enrichment class at the City pool again this summer and asked to pay actual costs rather than the pool rental fee.  Councilman Lester made a motion, second by Councilman Peterson to allow LCSC Outreach to use the pool for a scuba enrichment class at cost and coordinate with city clerk for dates.  Motion carried by a unanimous vote of the Council present.

ALLEY VACATION, VISTA VIEW APARTMENTS AND TED LINDLSEY:  Greg FitzMaurice explained they didn’t mean to make a false statement last meeting, but there is a violation on D Street with the stairway on the southwest corner of building being in the City right of way.

Councilman Lester stated he had met with Attorney Green at his office, and Public Works Director McFrederick at the site to look at the survey. On motion by Councilman Lester, second by Councilwoman Grant to vacate the west 8’ of the alley to Ted Lindsley, retaining a full utility and public easement for the 8’ being vacated contingent upon the following:

1.  Lindsleys grant an easement to the City for the existing storm drain in its current location. 2.  Lindsleys remove approximately 2’ of the deck built in 2013 to conform with the new property line caused by the proposed vacation of the 8’ of alley 3.  Lindsleys make application for a variance to allow the bump outs, balconies and decks to be in the setback. 4.  Planning and Zoning recommended approval to allow the bump outs, balconies and decks to be in the setback. 5.  Lindsleys apply and pay $166.50 for a building permit for the deck constructed in 2013 6.  Lindsleys application for a vacation and variance to fix similar problems on D Street where the existing stairway is currently on City property.

Councilman Lorentz questioned whether that will clear up everything.  It is believed it will.  Mayor Walker wanted to make sure the public easement is there as Williams were concerned about maintaining the alley in case they expand their business.  Attorney Green felt the access would be as it currently stands with the improvements already in place.  Attorney FitzMaurice stated he sees it as the City reserving the right to use that 8’ and feels Ted will take the risk.  Motion carried by a unanimous vote of the Council present.

DONATION FOR CHOCOLATE FANTASY:  On motion by Councilman Lorentz, second by Councilman Peterson to donate a family season pool pass to Chocolate Fantasy.  Motion carried by a unanimous vote of the Council present.
