Meeting of the Planning and Zoning Commission held March 24, 2020, 5:30 P.M. in the Council Chambers of City Hall.

The meeting was called to order by Mike Cook at 5:33 p.m.

APPROVAL OF MINUTES: On motion by Yolanda Stout, second by Dan Gautney to approve the minutes of February 25, 2020 as presented. Motion carried.

PUBLIC HEARING #1 ON THE CONDITIONAL USE APPLICATION TO ALLOW THE GROWING PATCH LEARNING CENTER, 327 W N 4TH TO OPERATE A DAY CARE CENTER, AFTER SCHOOL PROGRAM AND HOME SCHOOL TUTORING SERVICES IN A RESIDENTIAL ZONE: The public hearing was called to order at 5:35 p.m.

APPLICANT PRESENTATION: Maryann Gulotta stated the location is Grangeville Reformed Church at 327 W N 4th Street. Based upon the fire inspection, she can have a maximum of 40 students. She is planning a toddler day program/daycare center, after school program and tutoring services. She plans to have a maximum of 15 students in the toddler day program/daycare center and they have 2 teachers right now. According to Health and Welfare daycare licensing, they are approved for a maximum of 15 enrollees. They will also help tutor students after home schooling or public school is over. It’s a learning center and open to all, even non-church members.

STAFF PRESENTATION: City Administrator Kennedy reported all notices of hearing were delivered and published as required.

WRITTEN CORRESPONDENCE: A letter from Phil and Charity Ruhnke stating they had no objection to the day care center proposed.

APPLICANT REBUTTAL: none

Chairman Cook discussed findings of fact with the commission as discussed for conditional uses.

a. The conditional use does not unreasonable impact public health, general welfare or general interest in the community. None.

b. The proposed conditional use of property or structures will be appropriately located with respect to transportation facilities, water supply, fire and police protection, waste disposal and other similar facilities which might be needed for the proposed use. Currently being used as a church and it meets all these requirements. This use will not impact it differently.

c. The general neighborhood character and surrounding property values will not be unreasonably negatively impacted. None.

d. The proposed conditional use will not cause an undue traffic hazard or unreasonable parking problem in the use district in which the conditional use is proposed. They have off street parking made up of a parking lot and street parking.

e. There is no substantial community objection and the terms of section 10-10-3 of this chapter are incorporated herein as an additional condition to the granting of a conditional use. None

The hearing was closed at 5:46 pm.

DISCUSSION AND RECOMMENDATION: On motion by Yolanda Stout, second by Jeff Kutner to recommend to the City Council that the conditional use application requested by The Growing Patch Learning Center, 327 W N 4th to operate a toddler day program/day care center, after school program and home school tutoring services in a residential zone be approved as long as state guidelines are met. Motion carried.

PUBLIC HEARING #2 ON THE CONDITIONAL USE APPLICATION TO ALLOW MADELINE GILMORE, 627 S C, TO OPERATE AN ESTHETIC BUSINESS IN A RESIDENTIAL ZONE: The public hearing was called to order at 5:48 p.m.

APPLICANT PRESENTATION: Madeline Gilmore currently has a business at 507 W Main called Simply Beauty that she wants to operate in her home. It is hard to be a wife, business owner and mother so when they bought their home, one of the biggest draws was the ability to work from home due to the additional space and layout of the home. She has children and being able to work out of her home and have a clean environment and not worry about daycare is a positive. She does not feel it would disturb her neighbors as her business is quiet. She can only see one customer at a time and at any time, there would be a maximum of two, as the new appointment shows up and the previous appoint leaves. Her business is Esthetics – skin care, facials, lashes. She has a cosmetology license through the state board of licensing. They will inspect the property to make sure there are two sinks, a bathroom and separate entrance. The most people she could see in a day is six customers. She operates Tuesday – Friday, 9am – 6pm.

WRITTEN CORRESPONDENCE: Richard and Juinne Negus, 704 South C, stated they do not want any businesses in their residential area as C Street is already busy enough with traffic from the high school.

APPLICANT REBUTTAL: Madeline stated C Street is a busy street; however she lives on a corner. Her customers could park on Washington, C street or in her driveway for off street parking.

Chairman Cook discussed findings of fact with the commission as discussed for conditional uses.

a. The conditional use does not unreasonable impact public health, general welfare or general interest in the community. Based on the number of people on site at a time, there is no unreasonable impact.

b. The proposed conditional use of property or structures will be appropriately located with respect to transportation facilities, water supply, fire and police protection, waste disposal and other similar facilities which might be needed for the proposed use. Through the licensing board, she would be required to have her own bathroom, the addition of two sinks and a separate entrance. There is also a fire hydrant out front.

c. The general neighborhood character and surrounding property values will not be unreasonably negatively impacted. The previous resident had a daycare in house and many didn’t see a traffic flow problem. This business is low impact on traffic.

d. The proposed conditional use will not cause an undue traffic hazard or unreasonable parking problem in the use district in which the conditional use is proposed. Parking is available in the driveway and on Washington Avenue to allow other parking. One car an hour doesn’t affect the neighborhood.

e. There is no substantial community objection and the terms of section 10-10-3 of this chapter are incorporated herein as an additional condition to the granting of a conditional use. One objection was received, but one is not substantial.

The hearing was closed at 5:59 pm.

DISCUSSION AND RECOMMENDATION: On motion by Dan Gautney, second by Yolanda Stout to recommend to the City Council that the conditional use application requested by Madeline Gilmore, 627 S C to operate an Esthetic business in a residential zone be approved. Motion carried.

OFFICERS: On motion by Jeff Kutner, second by Yolanda Stout to keep the current slate of officers. Motion carried. Officers are Chairman Cook, Vice-Chair Asker and Secretary Gautney.
