Ordinance #881 – Trapping in City Limits

GRANGEVILLE CITY ORDINANCE NO. 881

AN ORDINANCE OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, PROVIDING REGULATION FOR TRAPPING WITHIN THE CITY; PROHIBITING THE SETTING OF TRAPS WITHIN CITY LIMITS, EXCEPT FOR LAW ENFORCEMENT PERSONNEL AND AS SPECIFICALLY AUTHORIZED BY THE CITY COUNCIL OR THE CHIEF OF POLICE; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; and, PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION; and,

WHEREAS, the purpose of the trapping regulation is to allow limited trapping to promote health, safety, and welfare while preventing unnecessary loss to property or injury to the public;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, STATE OF IDAHO, AS FOLLOWS, TO WIT:

Section 1:

TRAPPING REGULATIONS:
a) Definitions: Trap. Any mechanical device or snare which is designed to hold, capture, and/or kill an animal including, but not limited to, live traps, steel-jaw foothold traps, padded jaw traps, body-gripping (Conibear) traps, snares, deadfalls, leg-hold type traps, or similar devices.

b) Unless authorized by the Idaho Department of Fish and Game, pursuant to Idaho Code Title 36, Chapter 11, no person shall set a trap to catch an animal (other than a mouse, rat, gopher, vole, or mole) within City limits, except a person specifically authorized by the Council or by the Chief of Police or designee.

Section 2:

PENALTIES:
Any person violating these provisions shall be deemed guilty of an infraction and, upon conviction thereof, shall be punished pursuant to this Code and the Idaho Code, unless otherwise specifically provided for.

Section 3: All ordinances or parts of ordinances in conflict herewith shall be repealed.

Section 4: This ordinance shall be effective upon its passage, approval, and publication
in the Idaho County Free Press.

This ordinance passed under a suspension of the rule requiring three readings on separate
days at a regular meeting of the City Council held on the 17 day of December, 2012.
