GRANGEVILLE CITY ORDINANCE NO. 854

 AN ORDINANCE OF THE CITY OF GRANGEVILLE PROVIDING FOR THE AMENDMENT OF SECTION 8-5-3-1 OF THE MUNICIPAL CODE OF THE CITY OF GRANGEVILLE RELATING TO SEWER RATES; PROVIDING FOR INCREASE IN SEWER RATES AND INCREASING THE RATES OUTSIDE THE CITY LIMITS OF THE CITY OF GRANGEVILLE; CONTINUING THE DEFINITION OF THE USAGE RATE AS ESTABLISHED PURSUANT TO THE EARLIER DRAFT OF 8-5-3; PROVIDING FOR THE RETENTION OF THE REMAINDER OF SECTION 8-5-3; PROVIDING FOR THE ORDINANCE BECOMING EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION; AND, PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

 BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GRANGEVILLE, IDAHO COUNTY, IDAHO, AS FOLLOWS:

 Section 1:   Section 8-5-3-1 of the Grangeville Municipal Code shall be amended to read as follows:
SEWAGE RATES, RELIEF FOR VACANCIES IN RENTAL UNITS, AND MISCELLANEOUS COLLECTION PROCEDURES:

A. As calculated pursuant to section 8-5-3 of this chapter, the basic rate for sewer charges after a review by the City Council shall be $21.68 22.98 per month for all residents within the City and shall continue from the adoption of this section until the same shall be amended.  For residents outside of the City limits the following rate shall apply:  $43.36 45.96.

B. The usage rate as newly defined in section 8-5-3 of this chapter shall be 3.34 3.54 cents per cubic foot from the date of the adoption of this section for all residents within the City and the following rate shall be applicable to residents outside of the City:  6.68 7.08 cents per cubic foot.

C. The City Clerk shall maintain an office in the City Hall and shall keep the same open five days each week, Monday through Friday, during regular business hours established by the City Council for receiving payment and collection of water rates, rentals, and connection charges, together with sewer rates, rental and sewer connection charges as are provided throughout this code.  The City Clerk shall compute from the readings furnished him/her by the water superintendent the amount due from each customer and shall keep accounts with all utility customers in proper permanent books to be provided to him/her for that purpose at the expense of the City and said Clerk shall render monthly statements to each and every customer, keeping a duplicate thereof on file in his/her office and shall receipt the original when payment is made and of the amount due.

D. For each sewer connection that serves either a multi-facility unit or a residential rental unit, whether it be an apartment, single family dwelling or mobile home court, the owner shall pay sewerage charges as defined in section 8-5-3 of this chapter at the rate defined hereinabove.  However, if there is a vacancy in any such unit the owner shall notify the City Clerk of the vacancy.  During the vacancy the rate will then be reduced in the following manner:  one-half the normal rate.

To qualify for the continued reduction during vacancies, the owner must report monthly in writing to the City concerning such vacancies by the 1st of each month.  The City may, from time to time, verify vacancies by appropriate inspection or by the acceptance of other evidence.  Any owner will not qualify for the reduced vacancy rate unless the vacancy shall exist from at least 30 consecutive days.  Any false reporting shall cause a waiver of the right to a reduction for the ensuing 2 year period of time.

E. All of the foregoing rates and charges for sewerage service and any charges for other utilities that appear on the City utility bill shall be paid on or before the 10th day of each month and if not so paid become delinquent on said date and shall bear interest at the rate of 12% per annum from the date of delinquency until paid.

F. The owner of any property which is used as a seasonal recreational vehicle camping area or any seasonal campground which has one sewer connection for the entire property shall be obligated to pay one basic rate, together with the usage rate as would be required of a motel, and shall likewise be entitled to a reduction of 50% of the basic rate during those months that he is not open for business and has so certified his closure to the City Clerk in writing.  There shall be no reduction in rate for the months of May through October of each year.

 Section 2:  All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 Section 3:  This ordinance shall become effective upon its passage, approval, and publication in the Idaho County Free Press.

 This ordinance passed under a suspension of the rule requiring three readings on separate days at a regular meeting of the City Council held on the 8th day of September, 2009.
