Meeting of the Planning and Zoning Commission held March 31, 2026, 6:00 P.M. in the Council Chambers of City Hall.

The meeting was called to order by Kevin Asker at 6:02 p.m.
APPROVAL OF MINUTES: On motion by Dan Gautney, second by Yolanda Stout to approve the minutes of February 24, 2026, as presented. Motion carried.
PUBLIC HEARING #1: The public hearing was opened for a variance application submitted by Mountain View School District to place a shipping container approximately 1 foot into the F Street setback. It was questioned whether the commission could act on the application without a representative for the applicant. City Administrator recommended the commission move forward with the hearing and if the city attorney felt otherwise, a new hearing could be scheduled. She then read the information from the application on questions 6a and 6c, which stated they want to place a shipping container for vehicle and parts storage for the GHS car club and would need to place it in the setback of F Street by approximately 1foot.
APPLICANT PRESENTATION: No representative was present from Mountain View School District.
STAFF PRESENTATION: City Administrator Kennedy reported all notices of hearing were delivered to those property owners within 300’ and published in the paper for the public at large. Kennedy stated after the last meeting, she was able to find a survey on the west side of F Street. Public Works Director Mager then used the survey to find the pins and measure over to the shop building. The proposed storage unit is approximately 1’ in the required 10’ setback off F Street.

DISCUSSION AND RECOMMENDATION: James Zehner stated he went out there today because he missed last meeting and he was surprised to see there was a house. He questioned if F Street was built correctly and if the house was out of city. Administrator Kennedy explained Eberts live there and the property is in the city. F Street is correct as far as we know. The notices for both hearings were sent out to all property owners within 300’ of the property. Eberts were on the list and they were sent notices for both hearings. It was questioned if the city received comments on either application. Kennedy stated no comments were received.
Brian Perry questioned if the motion needed to include or duplicate any of the information from the least hearing. Administrator Kennedy explained that the Council already received the commission’s recommendation from last meeting. The Council acted on that recommendation to move forward with a shipping container in zone A contingent upon a new variance application to allow it in the F Street setback. Kevin Asker asked if the council agreed to all conditions in the motion from P&Z. Kennedy replied yes. Brian Perry questioned if they abandoned the project, would the container have to be removed. Kennedy stated yes. The Council agreed to all the conditions in the recommendation from the commission and also stated if it ceased to be used then it would need to be removed. It can’t be converted to regular storage for the school. Yolanda Stout stated a lean-to was mentioned last meeting and questioned if this request was for a shipping container or lean-to. Kennedy stated it was for a shipping container.
On motion by James Zehner, second by Dan Gatney that in light of all the time he has lived here, not much development has happened in that area, the road has been there for decades and he didn’t see it continuing to the north because of the bedrock issue, he felt the variance for setback encroachment should be granted. ROLL CALL VOTE: YES: Gautney, Stout, Perry, Zehner NO: none. ABSTAIN: none. The motion passed.
STAFF REPORT: As explained earlier, City Administrator Kennedy stated the variance application for a shipping container in Zone A was approved conditionally by the Council as recommended by the commission, as long as they applied for a variance for it to be located in the F Street setback. The final decision by the Council will be based upon tonight’s recommendation.
CORRECTED MINUTES: City Administrator Kennedy explained Lee Spencer’s vote in the roll call was missed in the January 27, 2026 minutes. On motion by James Zehner, second by Yolanda Stout to approve the corrected minutes. Motion carried.
FINDINGS OF FACT AND CONCLUSIONS OF LAW: City Administrator Kennedy explained she has been working with the city attorney to make sure all findings are in legal documents to meet city and state requirements. From this point forward, you will see these after each hearing. This change will also require a meeting the following month to adopt findings even if there is no hearing scheduled. It was questioned if that meeting could be online. Kennedy stated that option may be available if there is no hearing.
On motion by Dan Gautney, second by Yolanda Stout to adopt the Findings of Fact and Conclusions of Law on the following applications as presented. Motion carried.
• Angela Poxleitner’s variance for billboard installation at 1027 Highway 13
• Merrian Hanson’s conditional use for a salon at 208 E South 7th Street
• Chris and Emily Schacher’s variance for a covered post and beam structure over the front steps at 628 S A Street
• Freebird Holdings, LLC variance for a billboard at 331 W Main Street
• Derith E. Kettenburg’s conditional use for an upholstery business at 815 N Mill Street
• Mountain View School District #244 variance to have a shipping container in zone A at 910 S D Street
