Your right to public information

Every person has the right to examine and take a copy of any City of Grangeville public record. All public records are open for inspection except as otherwise expressly provided by statute. The City processes all requests in compliance with the Idaho Public Records Act, Idaho Code §§ 74-101 through 74-126.

Records released in response to a request are not warranted as to completeness or accuracy. The information provided represents disclosable information under Idaho Code Title 74, Chapter 1. Additional records from other sources may present a more complete picture of a given situation.

Costs

Most requests are fulfilled free of charge. For Idaho residents, there is no charge for the first two hours of staff time or the first 100 pages copied. Fees may apply beyond those thresholds. Non-residents may be charged fees from the first hour of labor and first page copied. If fees are anticipated, you will receive a written estimate before work begins. Payment is required before records are distributed. See Idaho Code § 74-102(10) for the complete fee schedule.

Police records are subject to additional restrictions. Records related to open or ongoing investigations, law enforcement investigative techniques, and information that could jeopardize a person’s right to a fair trial may be exempt from disclosure under Idaho Code §§ 74-105 and 74-124. All requests will be reviewed by the Grangeville Police Department before release.
Idaho residents receive an initial response within three (3) working days (up to ten working days if additional time is needed to locate records). Non-residents receive a response within twenty-one (21) days (up to thirty-five days). All requests are processed under Idaho Code §§ 74-101 through 74-126.

Writing
Includes, but is not limited to, handwriting, typewriting, printing, photostating, photographing, and every means of recording, including letters, words, pictures, sounds or symbols or combination thereof, and all papers, maps, magnetic or paper tapes, photographic films and prints, magnetic or punched cards, discs, drums, or other documents.

Resident
A natural person domiciled in the state of Idaho for at least 30 continuous days, or a domestic entity registered under Idaho Code § 30-21-102. Does not include a person’s workplace, vacation residence, or part-time residence, and does not include full-time students who are residents of another state.

The person or persons having personal custody and control of the public records in question.

Law enforcement exemption
Investigatory records compiled for law enforcement purposes are exempt from disclosure to the extent that disclosure would interfere with enforcement proceedings, deprive a person of the right to a fair trial, constitute an unwarranted invasion of personal privacy, disclose the identity of a confidential source, disclose investigative techniques, or endanger law enforcement personnel.

The right to listen, view, and make notes of public records, as long as the public record is not altered or damaged.

Transcribing by handwriting, photocopying, duplicating machine, or reproducing by any other means, as long as the public record is not altered or damaged.

Appeal of denial
A person whose request has been denied may petition the district court for review. The petition must be filed within 180 days of the date the denial letter is mailed.
