Meeting of the Planning and Zoning Commission held April 28, 2026, 6:00 P.M. in the Council Chambers of City Hall.

The meeting was called to order by Kevin Asker at 6:00 p.m.

APPROVAL OF MINUTES: On motion by Dan Gautney, second by James Zehner to approve the minutes of March 31, 2026, as presented. Motion carried.

PUBLIC HEARING #1: The public hearing was opened for a conditional use application submitted by Jenny McLean, 421 Lincoln Ave to allow her to operate a salon located in the carport at her home.

APPLICANT PRESENTATION: Jenny McLean explained they have a shop in the back of their carport. She is working to finish it off to have the salon in it so she can have her clients and business at her house. There is nowhere to rent another station in town, so the next best option for her and her family is to have it on their property. She is hoping to keep the majority of her clients from when she was working on Main Street.

Dan Gautney questioned if she would have a separate entrance and a bathroom and Jenny replied yes. James Zehner asked if Jenny was working now. Jenny stated she was renting a booth at Shear Magic but that ended in September. James questioned if the driveway to the east of her house was hers or if it was an alley. Jenny stated it is her neighbor’s property.

STAFF PRESENTATION: City Administrator Kennedy explained when city hall found out Jenny was adding a salon in her home, they contacted her and she immediately came in to complete the conditional use application. She didn’t know she had to go through the process. All notices of hearing were delivered to those property owners within 300’ and published in the paper for the public at large. City hall is currently working with Jenny on the building permit. She has submitted her plans and the building inspector has reviewed them. The inspector will meet her Friday on site. The permit is in process but it has not been paid and issued.

DISCUSSION AND RECOMMENDATION: On motion by James Zehner, second by Dan Gautney to recommend to the city council to allow a salon in her home according to the application. Motion carried.

James Zehner questioned when a roll call vote was needed. City Administrator explained the chairman can choose if he wants a roll call or not. If he felt it was a controversial vote he may require it or he could require it all the time. It is personal preference. The Council has specific requirements that require roll call votes which include ordinances and contracts.

Chairman Asker reminded everyone not to reply to all on emails.

STAFF REPORT: City Administrator Kennedy stated the variance application for a shipping container in the setback for Mountain View School was approved by the Council as recommended.

FINDINGS OF FACT AND CONCLUSIONS OF LAW: On motion by James Zehner, second by Brian Perry to adopt the Findings of Fact and Conclusions of Law on Mountain View School District #244 variance to have a shipping container in the F Street setback. Motion carried.
