The City Council met in regular session on December 3, 2018 at 6:00 P.M. in the Council Chambers City Hall.

City employees present were Chief Drew, Public Works Maintenance Supervisor Mager, Attorney Green and Clerk Kennedy. Public Works Director McFrederick absent.
PLEDGE OF ALLEGIANCE
MINUTES: The meeting was called to order and the minutes of November 18th were approved as presented by Councilor Peterson, second by Councilor Grant. Motion carried by a unanimous vote of the Council present.
COMMITTEE REPORTS: Public Works Report – Maintenance Supervisor Mager stated the department has been working on maintenance and preparing for snow and winter. The survey that went out to various businesses is for the WWTP and is required by DEQ to determine pretreatment.
On motion by Councilor Peterson, second by Councilor Farris to accept the Library Minutes of November 15, 2018. Motion carried by a unanimous vote of the Council present.
WATERSHED ACCESS: Silas Whitely had stated at the last meeting that Bennet’s were going to give him an easement through their property, but he doesn’t have it yet. Councilor Grant said Silas had told the City he was covering his bases, and she felt if that was the case, and he already has the easement from Bennett’s, then the City shouldn’t need to provide an easement. Mayor Lester asked what the downside was. Attorney Green stated then someone has the legal right to go over the property. Councilor Grant felt the City should protect the watershed.
On motion by Councilor Grant, second by Councilor Lane to deny Silas Whitely access through the watershed for an easement. Councilor Grant stated Silas won’t be the owner forever and the City needs to look to the future. Motion carried by a unanimous vote of the Council present.
LIBRARY BOARD: Clerk Kennedy explained she’d been working with the Librarian to correct the board terms for existing members to expire December 31st of each year, so only one board member goes off each year. Susan Anderson agreed to a 3-year term. Brett Rogers will go off this year. On motion by Councilor Farris, second by Councilor Canaday to appoint Susan Anderson to a 3-year term, expiring December 31, 2021 and to correct the remaining board terms for existing board members with expiration of terms on December 31st. Motion carried by a unanimous vote of the Council present.

POLICE VACATION: Clerk Kennedy explained the current handbook explains the vacation payout occurs the pay date before Christmas, but it really should be the last playdate of January to allow reconciliation of hours. On motion by Councilor Farris, second by Councilor Peterson to allow unused vacation for the police department to be paid in January and then change it to January during a future handbook change. ROLL CALL VOTE: YES: Canaday, Farris, Winkler, Lane, Grant, Peterson. NO: none. The motion passed.
POLICE LEASE FOR VEHICLE: On motion by Councilor Grant, second by Councilor Lane to authorize the Mayor to sign the Master Lease agreement with The Bankcorp for the police vehicle purchase. ROLL CALL VOTE: YES: Canaday, Farris, Winkler, Lane, Grant, Peterson. NO: none. The motion passed.
WATERSHED TIMBER HARVEST CONTRACT: On motion by Councilor Winkler, second by Councilor Peterson to authorize the Mayor to sign the Watershed Timber Harvest Contract with JG Logging. ROLL CALL VOTE: YES: Canaday, Farris, Winkler, Lane, Grant, Peterson. NO: none. The motion passed.
CATERING PERMIT: On motion by Councilor Winkler, second by Councilor Farris to approve the catering permit for Cottonwood Mini Village to cater Christmas parties at the Rib Guy and Gal, 45 Hwy 95 N, on December 7th and 22nd, 2018 from 5pm-9pm. Motion carried by a unanimous vote of the Council present.
COUNCIL MEETING DATE: On motion by Councilor Peterson, second by Councilor Lane to adopt the 2019 Council Meeting dates. Motion carried by a unanimous vote of the Council present.
EXECUTIVE SESSION: On motion by Councilor Peterson, second by Councilor Grant
to go into Executive Session according to Section 74-206 (b) Personnel ROLL CALL VOTE: YES: Canaday, Farris, Winkler, Lane, Grant, Peterson. NO: none. The motion passed.
The Council returned to regular session. No action was taken.
