Meeting of the Planning and Zoning Commission held May 28, 2024, 6:00 P.M. in the Council Chambers of City Hall.

The meeting was called to order by Mike Cook at 6:00 p.m.

APPROVAL OF MINUTES: On motion by Dan Gautney, second by Kevin Asker to approve the minutes of February 27, 2024 as presented. Motion carried.

PUBLIC HEARING #1: The public hearing was opened at 6:02 pm.

APPLICANT PRESENTATION: Steven Riggle, 620 W South Street, stated he is on the corner of South and C Streets across from Grangeville Builders. The house and garage were built in 1939. He would like to build a carport in front of garage the same width as the existing garage. He does not plan to attach it to the garage. He will build it out of milled lumber and it will have curb appeal.

STAFF PRESENTATION: City Administrator Kennedy reported all notices of hearing were delivered to adjoining property owners and published in the paper as required. Steve’s proposal meets the required setback on South Street, however on C Street it is 8’ into the required setback; the existing garage is also 8’ into the C Street setback.

Public Works Director Mager stated he worked with Steve to reduce the carport size to 20’ so it was not in the vision triangle. If something happens in the future to the garage that destroyed it, the new construction would need to comply with current city code. The carport is unattached so it could be moved in the future.

Brian Perry asked if it is a post and pole carport. Steven Riggle stated it is timber framed and the walls are not enclosed.

DISCUSSION AND RECOMMENDATION: James Zehner asked if when constructed will the carport face south and will it be further out than the house. Steven stated yes it will face South Street and it won’t be out further than the house. Dan Gautney felt there would no visible obstructions at the corner with the proposed carport.

On motion by James Zehner, second by Dan Gautney to recommend to the council to approve the variance submitted by Steven Riggle for a carport. Motion carried by a unanimous vote of the Council present.

PUBLIC HEARING #2: The public hearing was opened at 6:09 pm.

APPLICANT PRESENTATION: Jerry Cloninger, Clonco LLC/Cloningers Inc. stated he wants to cover the loading dock to keep snow and ice off the stairs. It is a safety issue on the stairs coming off the dock; they’ve had someone fall and get hurt on the icy stairs. They will have snow bars on the roof so the snow can’t fall off onto the sidewalk. James Zehner questioned if they will have rain gutters so the rain doesn’t drain onto the sidewalk. Jerry stated yes, they will have it piped correctly with the rest of the rainwater from the property. Kevin Asker pointed out on the map the channel in the sidewalk that drains water.

STAFF PRESENTATION: City Administrator Kennedy reported all notices of hearing were delivered to adjoining property owners and published in the paper as required. On the zoning map, Kennedy pointed out the zoning to the north. All the Cloninger’s property is zoned commercial. Most of the property to the north is also commercial, with the exception of the property on the corner of the block which is residential zone A. Because the loading dock abuts a residential zone, a 5’ setback is required.

Public Works Director Mager stated the loading dock in compliance. It’s just the staircase in the setback that they want to cover that doesn’t meet code.

DISCUSSION AND RECOMMENDATION: On motion by Dan Gautney, second by James Zehner to recommend to the Council to approve the variance application for the Cloninger’s loading dock cover. Motion carried.
