Meeting of the Planning and Zoning Commission held September 26, 2023, 6:00 P.M. in the Council Chambers of City Hall.

The meeting was called to order by Mike Cook at 6:00 p.m.

APPROVAL OF MINUTES: On motion by Dan Gautney, second by Kevin Asker to approve the minutes of August 29, 2023 as presented. Motion carried.

PUBLIC HEARING #1: The public hearing was opened at 6:01 pm. No public present.

APPLICANT PRESENTATION: Jim Daniels, 731 S Idaho explained he bought a building permit in the spring for siding and roofing his house. As he got into the project, with it being an old house it had 2’x4’ construction, no insulation, bare wires, dry rot and it couldn’t support new roof or other siding. As the project progressed, he needed to redo a lot of things. The front room was torn down and he rebuilt it on the same foundation. He plans on pouring sidewalks out front. He added on a small addition on the north side of the portion he tore off and replaced and he plans to have a covered deck extending to line up with the original portion of the house along S Idaho to make it more of a rectangle. He bought a permit but didn’t understand he could only use it for roofing and siding. The permit was for $25,000 and he’s only spent $6,000 in materials. He didn’t include labor originally.

Brian questioned whether the new rebuild is closer to the street than the original building. Jim responded it is no closer. He’s trying to square off the building with the corrections.

STAFF PRESENTATION: City Administrator Kennedy reported all notices of hearing were delivered to adjoining property owners and published in the paper as required. Kennedy explained historically if repair was being done to an existing structure and at least a wall of the structure was left in place, then the building didn’t have to become compliant with all setbacks. For this reason, the small addition to the north and covered deck are included in the variance request, not the original portion that was torn off and replaced on the existing foundation.

Public Works Director Mager stated the project is far enough from the alley and other Idaho intersections so it doesn’t interfere with traffic or visibility. There is no infrastructure involved except for installation of sidewalk, curb and gutter. Mike asked if there were any other site issues. Bob responded no.

DISCUSSION AND RECOMMENDATION: On motion by Brian Perry, second by Dan Gautney to recommend to the city council to approve the variance submitted by Jim Daniels, 731 S Idaho Avenue for the 24’x16’ addition because it doesn’t affect the setback of the existing structure. ROLL CALL VOTE YES: Cook, Perry, Asker, Gautney, Stout NO: None. The motion passed.
